Mientras las empresas y las consultoras de formación estamos con el cierre de 2016 y comenzando a dar de alta acciones formativas para el 2017, la Fundación Estatal para la Formación en el Empleo (Fundae) ha notificado el 29 de diciembre de 2016 que ya se ha procedido a comprobar el ejercicio 2015.
¿Qué hay que hacer?
Tras la verificación de datos que ha hecho Fundae con la Tesorería General de la Seguridad Social, se ha incluido una nueva pestaña en la aplicación telemática de 2015 para que podamos comprobar si dicho ejercicio es conforme (que está todo correcto) o no lo es (hay discrepancias entre lo notificado y lo comprobado). En la siguiente ruta podréis ver en qué estado está la empresa que queréis comprobar: Datos de Empresa o Empresas Participantes > Datos Económicos > Comprobación de resultados.
Si resulta ser CONFORME, la comunicación es telemática en el apartado que hemos comentado. Esto no exime de posibles comprobaciones posteriores por parte de los Servicios Públicos de Empleo y de otros órganos de control.
Si resulta NO CONFORME, las empresas recibirán una notificación escrita en este sentido. Hay que tener en cuenta diversas cuestiones:
- La notificación por escrito le llega a la empresa que se ha bonificado los cursos, no a la/s consultora/s que haya/n gestionado la formación.
- La carta va a nombre del representante que se ha notificado en la aplicación. ¡OJO! Una vez recibida y firmada por quien sea, comienzan a correr los días para poder hacer alegaciones y/ o el pago si procede. Es muy importante entregar la carta con la información a quién vaya a gestionar la no conformidad del ejercicio en cuestión.
- Si la empresa gestionó su formación a través de alguna consultora de formación, debe ser ésta quién notifique a la empresa la comprobación del ejercicio 2015, ya que en muchos casos las empresas beneficiarias de las bonificaciones no saben cómo mirarlo o no han entrado nunca en la aplicación.
- Se puede hacer una primera revisión en los apartados correspondientes para comprobar si la empresa cumplió con los criterios que marca Fundae como son la cofinanciación privada y los colectivos prioritarios, aunque este último criterio en principio se supone que no lo tienen en cuenta para dicho año.
- También se puede comprobar si hay alguna diferencia detectada en el importe aplicado o en los meses que se realizó dicha deducción.
- Si todo parece estar correcto hay que esperar a la carta para comprobar que ha ocurrido. Los errores más comunes suelen ser:
- Discrepancias con algún dato de los trabajadores (ej.: no estaba dado de alta un trabajador al comienzo de la formación).
- La empresa ha deducido el importe de algún autónomo.
- No se ha llegado a la cofinanciación privada exigida.
- Se ha deducido un importe distinto al notificado.
- Se ha deducido el importe en otro ejercicio y no en el que debía por lo que tendrá que devolver la cantidad correspondiente.
- Ha habido inspección en alguna acción formativa y la han anulado.
- En la notificación aparece un código CSV que permite la consulta de los anexos que motivan la diferencia detectada. Para poder hacer la comprobación solo hay que ir al apartado «Consulta documentación mediante el C.S.V».
Al realizar formación a través de este sistema todos tenemos que entender que puede haber revisiones y que siempre tenemos que hacer todos los trámites de la mejor manera y de forma transparente. Si es necesario se puede contar con expertos como Formagesting para este tipo de gestiones.
