Real Decreto que desarrolla la Ley de Formación Profesional para el empleo en el ámbito laboral

El Consejo de Ministros el 3 de julio aprobó el nuevo Real Decreto 694/2017, por el que se desarrolla la Ley 30/2015, de 9 de septiembre. Todos los que nos dedicamos a la formación estábamos esperando que desarrollaran y publicaran dicho Real Decreto.

Entra en vigor a partir del 6 de julio de 2017 y pretende regular las iniciativas de formación profesional para el empleo. Dando detalles de los requisitos, límites, destinatarios, acreditación y un largo etcétera , sin olvidarnos del cheque de formación.

Consta de 36 folios y tras leerlos hay algunas cuestiones que aclaran algo, aunque la mayoría del texto es igual a la Ley.

En un mundo más global, en el que las empresas realizan negocios y formaciones en otras partes del mundo, desde que en el 2015 se aprobó esta nueva ley se vuelve a dejar fuera la formación que proporcionan empresas extranjeras que no tienen sede en España, así como las formaciones que puedan realizar trabajadores al desplazarse a otros países. Abogamos por una formación de calidad, transparente y adecuada al sistema productivo del país, por ese motivo, también hay que tener en cuenta otras tendencias que están vigentes desde hace tiempo para mejorar los conocimientos de los trabajadores.

A continuación detallamos algunos de los puntos del Real Decreto 694/2017:

  • Se pretende fomentar la formación en modalidad presencial y muy especialmente la online. También se tiene en cuenta la modalidad mixta en la que se engloban las dos.  La formación a distancia se puede seguir haciendo de manera privada sin financiación de fondos públicos.
  • Se pretende responder a las necesidades del sistema productivo y la competencia empresarial, contribuyendo a un modelo productivo basado en el conocimiento.
  • Cada tres años se elaborará un escenario plurianual para la planificación de las iniciativas del sistema de formación profesional para el empleo, según las necesidades de los trabajadores, de los desempleados y del sistema productivo de forma general.
  • En formación programada no será obligatorio que las acciones formativas estén referidas al Catálogo de Especialidades Formativas.

 

  • IMPORTANTE: No se consideran acciones formativas las actividades de índole informativa o divulgativa ni las que tienen una duración inferior a dos horas. Tienes que tener en cuenta que las jornadas, charlas, sesiones informativas sobre distintos temas no se pueden bonificar. Esto siempre ha sido así.

 

  • A TENER EN CUENTA: Los trabajadores no podrán realizar más de ocho horas diarias de formación, salvo cuando en la formación programada por las empresas para sus trabajadores la impartición de la acción formativa se concentre en una sola jornada con una duración superior a la señalada. En modalidad de teleformación, el número de horas indicado estará referido a los alumnos y a la dedicación del tutor-formador.

 

  • TELEFORMACIÓN:
    • Se considera modalidad de teleformación cuando la parte presencial que la acción formativa precise sea igual o inferior al 20% de su duración total.
    • Se debe realizar en una plataforma virtual con posibilidad de interactividad de alumnos, tutores y recursos, asegurando la gestión de los contenidos, seguimiento continuo en tiempo real y teniendo en cuenta la evaluación de todo el proceso.
    • Los requisitos generales de la teleformación, de la asistencia tutorial así como de la experiencia del tutor ya están recogidos en un documento previo y del que hablamos hace ya meses en el blog. Si quieres ver más sobre este tema pincha en teleformación.

 

  • PRESENCIAL:
    • Se da importancia a la formación por competencias y aun proceso de aprendizaje acorde al puesto de trabajo.
    • Se entiende como competencia a la adquisión de destrezas, conocimientos y capacidades.
    • Los grupos podrán tener hasta un máximo de 30 participantes en formación programada.

 

  • GRUPOS DE EMPRESAS:
    • Las empresas que quieran pueden agruparse por razones de eficacia empresarial, actuando una de ellas como entidad organizadora.
    • Las empresas que se agrupen con menos de 100 empleados podrán contratar a entidades organizadoras para que les gestionen la formación. Teniendo en cuenta que cada empresa en este caso solo podrá disponer de su propio crédito.

 

  • CRÉDITO DE FORMACIÓN:
    • Las empresas de menos de cincuenta trabajadores podrán comunicar a la Administración Pública competente, durante el primer semestre del ejercicio en curso (ya para el 2017 no tiene validez), la voluntad de acumular su crédito de formación para el año siguiente o los dos siguientes.

 

  • CHEQUE DE FORMACIÓN:
    • Las comunidades autónomas son las encargadas de ponerlo en marcha.
    • El objetivo prioritario es lograr la inserción laboral de los trabajadores desempleados en los empleos que requiera el mercado de trabajo.
    • La impartición de la formación la realizarán las entidades de formación acreditadas y/o inscritas para tal fin.
    • El servicio de empleo se encargará de entregar el cheque formativo que acredite a los trabajadores desempleados  a realizar las acciones formativas oportunas.
    • Este cheque posibilitará al trabajador a participar en una actividad formativa con un coste preestablecido, sin que tenga que hacer ninguna aportación dineraria por su cuenta.
    • Los servicios públicos de empleo son los encargados de detectar las necesidades formativas de los trabajadores desempleados.
    • El trabajador podrá elegir entre las entidades de formación seleccionadas por la Administración Pública competente para realizar la formación que necesite.
    • Una vez finalizada la formación y su justificación, será la Administración Pública la que pagará a la entidad de formación.
